Waterford Township Police Chief Cleared of Crime of the Century

Ok, so it really wasn't the crime of the century.

Not even close.

Waterford Township Police Chief Dan McCaw was accused of removing a campaign sign that read: “Vote No on the Millage It’s a tax increase!”

The Genesee County Prosecutor’s Office was overseeing the matter instead of Oakland County, which had recused itself because of a conflict of interest, Dave Phillips of the Oakland Press reports.

The Genesee County Prosecutor's Office announced Wednesday that no charges would be filed against the chief, the paper reported. 

“After a complete review of the evidence presented by the State Police, Prosecutor (David) Leyton determined that probable cause does not exist that McCaw had committed a crime,” the release states.

McCaw has been on paid administrative leave since Sept. 25.

Interestingly, officials said the sign was illegally placed in the public right-of-way before being removed by McCaw, officials said.

“As Chief of Police for Waterford Township, McCaw was within the realm of his official duties in choosing to remove the sign in question from the right of way,” the release states.

However, the sign had been placed next to signs supporting the police millage, which passed in the Aug. 5 primary election.

“The fact McCaw may have chosen to remove some signs and not others was irrelevant as to the question of whether a crime was committed,” Leyton stated.

Mmm. Sounds like selective enforcement of the law. -- Allan Lengel
